1. Acceptance of Terms

Welcome to WebSecurityScore. By accessing or using our web security testing platform and services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you (either an individual or an entity) and WebSecurityScore, Inc. (“WebSecurityScore,” “we,” “us,” or “our”).

By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

WebSecurityScore provides automated web security testing and vulnerability assessment services. Our Services include:

  • Automated security scanning of web applications and websites
  • Vulnerability detection and reporting
  • Security score calculation and tracking
  • Team collaboration and management tools
  • API access for integration with development workflows
  • Compliance mapping and reporting

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We recommend using strong passwords and enabling multi-factor authentication. You agree not to share your account with others.

3.3 Domain Verification

Before scanning any domain or website, you must verify ownership or obtain explicit permission from the owner. Scanning websites without authorization may violate laws and these Terms.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes. You may not:

  • Scan websites or applications you do not own or have permission to test
  • Use the Services to conduct malicious attacks or unauthorized penetration testing
  • Attempt to circumvent security measures or access controls
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use the Services to violate any applicable laws or regulations
  • Interfere with or disrupt the Services or servers
  • Upload malware, viruses, or malicious code
  • Impersonate others or misrepresent your affiliation
  • Collect or harvest user data without consent
  • Resell or redistribute the Services without authorization

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.

5. Intellectual Property

5.1 Our Intellectual Property

The Services, including all content, features, functionality, software, and technology, are owned by WebSecurityScore and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 Your Content

You retain ownership of any data, content, or information you submit to the Services (“Your Content”). By submitting Your Content, you grant us a limited license to use, store, and process it solely to provide the Services.

5.3 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback without any obligation to you.

6. Payment and Billing

6.1 Subscription Plans

We offer various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to pay the fees specified for that plan. Fees are billed in advance on a monthly or annual basis, depending on your selection.

6.2 Payment Method

You must provide a valid payment method (credit card or other accepted method) to purchase a subscription. You authorize us to charge your payment method for all fees incurred. We use third-party payment processors (e.g., Stripe) to process payments securely.

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee. We will notify you of any price changes in advance.

6.4 Coin System

Our coin-based system allows you to purchase coins for on-demand factor-level scanning. Coins are non-refundable and do not expire. Coin prices and bonuses are subject to change.

6.5 Taxes

All fees are exclusive of taxes. You are responsible for paying all applicable taxes, including sales, use, and value-added taxes.

7. Refund Policy

We offer a 14-day free trial for new users. After the trial period, all subscription fees are non-refundable except as required by law or as follows:

  • If you cancel within 7 days of your first paid subscription, you may request a full refund
  • If we terminate your account for reasons other than violation of these Terms, we will provide a pro-rated refund
  • Refunds are processed within 10 business days to the original payment method

8. Service Availability

We strive to provide 99.9% uptime for our Services. However, we do not guarantee uninterrupted or error-free service. The Services may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Third-party service outages
  • Force majeure events beyond our control

We are not liable for any damages resulting from service interruptions or downtime.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT RESPONSIBLE FOR SECURITY VULNERABILITIES NOT DETECTED BY OUR SCANS

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless WebSecurityScore and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Unauthorized scanning of websites or applications
  • Your Content or data submitted to the Services

11. Termination

11.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Services until the end of the paid period.

11.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide notice when possible, but are not obligated to do so.

11.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. We may delete your account data after 30 days. You may request a data export before termination.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@websecurityscore.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes.

12.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association’s rules. Arbitration will be conducted in San Francisco, California.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in San Francisco County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms with a new “Last Updated” date
  • Sending an email notification to your registered email
  • Displaying a prominent notice on the Services

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.
